2. Acceptance of Terms
By accessing this website or submitting an enquiry form, you confirm that:
- You are at least 18 years of age or the legal age of majority in your jurisdiction, whichever is higher.

- All fees are quoted and payable in Malaysian Ringgit (RM).
- Payment terms and methods will be confirmed in the written engagement letter issued before service commencement.
- Fees are payable as agreed in the engagement letter. We reserve the right to pause service delivery if payment obligations are not met.
- Refunds are considered on a case-by-case basis depending on the stage of service delivery. We will discuss any refund requests in good faith.
- Fees displayed on this website are indicative. Final fees are confirmed in the engagement letter and may be adjusted for bespoke scopes.
7. Service-Specific Terms
The following conditions apply to all Berlian service engagements:
- Scope: The scope of each engagement is confirmed in writing before commencement. Any additions to scope require a written amendment.
- Confidentiality: We treat all client information and circumstances as confidential and do not share them with third parties except as required for service delivery.
- Timeline: Indicative timelines are shared at the start of each engagement. Timelines may be affected by property availability, owner responsiveness, and client availability.
- No commission: Berlian operates on a fee-based model. We do not receive commission from property owners or developers, preserving the independence of our advisory.
8. Disclaimers
This website and our services are provided in good faith. However, please note:
- We do not make any promises regarding the availability of specific residences, rental prices, or the outcome of tenancy negotiations.
- Property market conditions in Kuala Lumpur can change. Our assessments are based on conditions at the time of engagement.
- Information on this website is for general reference and does not constitute legal, financial, or investment advice.
- We are not a licensed real estate agent and do not represent landlords or developers.
9. Limitation of Liability
To the extent permitted by Malaysian law, Berlian's liability for any claim arising from our services or website use is limited to the total fees paid by you in the relevant engagement.
We are not liable for indirect, consequential, or incidental losses, including loss of opportunity, disruption to relocation plans, or any loss arising from matters outside our reasonable control (including third-party actions by landlords, authorities, or utilities providers).
10. Termination
Either party may end a service engagement by providing written notice. In such cases:
- Fees for work completed to the point of termination remain payable.
- We will return any client materials provided to us during the engagement.
- Confidentiality obligations survive termination and remain in effect.
- Berlian reserves the right to terminate an engagement immediately if a client provides materially false information or acts in a manner that makes continued engagement impractical.
11. Dispute Resolution
These Terms are governed by the laws of Malaysia. In the event of a dispute:
- We encourage both parties to seek resolution through direct, good-faith communication within 30 days of the dispute arising.
- If informal resolution is not reached, the matter may be referred to mediation under the Mediation Act 2012 (Malaysia).
- If mediation is unsuccessful, disputes shall be subject to the exclusive jurisdiction of the courts of Kuala Lumpur, Malaysia.
12. General Provisions
- Entire Agreement: These terms, together with any written engagement letter, constitute the entire agreement between the parties.
- Severability: If any provision is found to be unenforceable, the remainder of these terms continues in full effect.
- Waiver: Failure to enforce any provision does not constitute a waiver of future enforcement rights.
- Assignment: You may not assign your rights under these terms without our prior written consent.

13. Changes to These Terms
